My practice primarily focuses on bankruptcy, insolvency and financial restructuring, creditors’ rights, and commercial litigation. I routinely assist various constituencies, including Chapter 7, 11 and 13 debtors, Chapter 7 and 11 trustees, creditors’ and equity security holders’ committees, commercial landlords, equipment lessors, private lenders, and asset purchasers.In addition to counseling Chapter 7 and 11 commercial debtors, Chapter 7 and 13 consumer debtors, and Chapter 7 bankruptcy trustees, responsibilities have involved 11 U.S.C. § 363 sale transactions, confirmation of standard Chapter 11 and Subchapter V plans, and the prosecution or defense of preference, fraudulent transfer, equitable subordination, non-dischargeability, substantive consolidation, “bad faith” filings and automatic stay disputes. Additional responsibilities have further involved the enforcement of rights under domestic and foreign commercial contracts and leases, licenses and intellectual property agreements.

Provided outsourced legal services to Pennsylvania attorneys. Work focused on research, analysis and legal writing. Products and services provided include – appellate briefs, trial court motions and pleadings, internal memoranda, analysis of potential claims, updates of existing research, and introductory searches to highlight avenues for client’s further inquiry or study.

Represented Chapter 11 debtors and Chapter 7 bankruptcy trustees. Work focused primarily on bankruptcy, insolvency issues and commercial litigation with an emphasis on debtor/creditor rights, and the prosecution or defense of preference, fraudulent transfer, involuntary bankruptcy, turnover, non-dischargeability, plan confirmation and automatic stay disputes.In addition, was responsible for most legal research and analysis projects at the firm, the drafting, editing and proofreading of all legal memoranda to be filed, and the preparation and arguing of every appellate matter in federal court. Further duties included participating in settlement negotiations, workouts, assisting partners in CLE presentations, and reviewing, rewriting and updating a selected bankruptcy treatise every year.

Responsible for writing some of the Judge’s most complex opinions. Duties included research and analysis, assessment of legal issues involved, and drafting and editing every bankruptcy opinion assigned. At the same time, was responsible for proofreading, rewriting and commenting upon the rest of the Judge’s opinions, memoranda and court orders.Further duties included preparing 11 U.S.C. § 362 memoranda, reviewing the Judge’s list of bankruptcy decisions currently on appeal, revising the Judge’s fee applications data list, updating the Judge’s monthly list of published opinions, monitoring bankruptcy and district court proceedings, and tracking and briefing each bankruptcy case appealed to the Third Circuit every month. The remainder of my time was spent supervising the Judge’s student interns, contacting other judges’ chambers, updating the Judge’s law library, and retrieving and analyzing newly-published materials (law reviews | journals | periodicals | case law | treatises) for upcoming assignments and/or projects.

Managed all aspects of corporation’s bankruptcy and consumer law practice. Particular emphasis on Chapter 7 and Chapter 13 bankruptcies, debt collection harassment, foreclosure litigation, credit card liability, and garnishments and attachments. At the same time, participated in a team to help the corporate president design, create, and implement a statewide legal hotline to address the needs of low-income clients with housing, family and consumer legal problems.Duties included initial client interviews, assessment of legal issues involved, and direct representation and/or assistance of consumer debtors. In addition, was responsible for researching, analyzing and monitoring newly enacted federal and state legislative consumer proposals affecting low-income clients in the state of New Jersey. Further duties included training, assisting and advising statewide legal services’ attorneys in dealing with consumer legal problems. The remaining twenty (20%) percent of my time was devoted to other practice areas (landlord/tenant issues | expungement of criminal records | name changes | lemon law).

Conducted all aspects of partnership’s bankruptcy and domestic relations practice. Particular emphasis on Chapter 7 and Chapter 13 debtors and no-fault divorces. Duties included initial client interviews, all subsequent client contact, and the preparation and filing of voluntary petitions, schedules, statements of financial affairs, Chapter 7 debtors’ statement of intentions, Chapter 13 plans and responses to adversary complaints.In addition, was responsible for preparing and drafting simple wills, advance health-care directives (living wills), codicils, powers of attorney, and trusts for elderly clients in the Philadelphia and Montgomery county areas. Other duties included negotiating, litigating and settling agreements for the sale of real estate for the Hispanic community in Philadelphia.

Handled most of the legal work assigned by the president of the corporation, including – real estate development, commercial lease negotiations, tax planning, general bankruptcy (creditors’ rights), contract, corporate and property law work. Consulted with outside counsel on litigation involving the corporation and advised company president and other corporate officers on litigation strategy. Drafted commercial property leases, motions and complaints, including – relief from automatic stay, rejection of executory contract, eviction, adequate assurance and adequate protection pleadings.

Researched and wrote briefs and memoranda on a wide range of legal issues, including – contracts, bankruptcy, torts, water rights, workers’ compensation, domestic relations, environmental, administrative and constitutional law. Prepared interrogatories and depositions. In addition, participated in discovery procedures, hearing preparation, strategic decision making and negotiation. Also, drafted various motions for state and federal court, including motion for summary judgment, motion in opposition to summary judgment, motion to dismiss for lack of jurisdiction and motion requesting voluntary dismissal of appeal.

Researched, analyzed and prepared legal memoranda concerning workers’ compensation law issues involving reinstatement rights, uninsured employers, insurance policies, and assessment and collection of premiums. Assisted Law Professor in the research and production of a workers’ compensation legal study examining the differences and similarities between local law and the legislation enacted in the fifty states.

Assisted first-year students in developing skills for their legal research and writing classes. Prepared weekly lessons and provided legal research assignments. Other duties and responsibilities included – scheduling office hours twice a week to answer questions about the classes, and easing students' transition into law school. At the same time, provided Law Professor with legal research and writing in numerous constitutional, civil rights, and family law issues for low-income individuals in the San Juan metropolitan area.

Analyzed application of newly amended Clean Air Act in preparation for investigation of environmental violations. Researched and prepared legal memoranda on numerous issues such as interstate transport commissions, risk management methodology, sulfur dioxide emission limitations, sulfur dioxide reduction permits and mobile sources.
