British Columbia (Interior Health Authority), 2017 BCSC 42 - my client was terminated after just over 2 months on the job without compensation for failing to complete probation. The court found that the employer failed to perform its obligation to assess probation in good faith and awarded severance pay and other contract damages;Director of Employment Standards -and- Enabil Solutions Ltd., ER#158-334 (2016) - My client's employer refused to pay bonus pay. After an Employment Standards Branch hearing the employer was ordered to pay more than $129,000 for non-payment of bonus wages and severance due to breaching the employment contract.Vernon v. British Columbia (Liquor Distribution Branch), 2012 BCSC 133 - A 30 year liquor store manager was wrongfully dismissed for just cause. The court awarded 18 months of severance (the maximum for a BC government employee), and an additional $85,000 in aggravated and punitive damages for the employer's bad faith in the way it terminated Ms. Vernon; McIntosh v. Metro Aluminum Products and Augustynowicz, 2011 BCHRT 34 - A sexual harassment case involving "sexting" by my client's boss where the Human Rights Tribunal awarded my client about $30,000 in damages; and,I am a actively involved with the Canadian Bar Association BC Branch serving on the Provincial Council and Sections Standing Committee and a member of the Trial Lawyers’ Association of British Columbia.
