Counsel in complex commercial and securities litigation in Malaysian courts. Legal adviser to South East Asia's largest cryptocurrency exchange and Malaysia's financial markets professionals' trade body. Securities litigation matters include 8 civil enforcement proceedings acting as counsel for the Securities Commission of Malaysia seeking disgorgement of profits and punitive damages arising from Ponzi and other fraudulent investment schemes, insider trading, market manipulation, making false representations to the investing public, issuing fraudulent accounts for public listed companies, breaches of fund manager regulatory guidelines and a multi-stage “pump and dump” share price manipulation scheme. Represented a major market participant in successfully resisting regulatory charges of market manipulation in Malaysian equity derivatives, and the first Malaysian company to have been listed on the Frankfurt Stock Exchange, in a RM35 million shareholder dispute. Acted for bondholders in 2 bond disputes with values exceeding RM150 million and RM290 million respectively, brought against the issuers, lead arrangers, underwriters, trustees and professional advisors (including valuers, reporting and monitoring accountants and auditors).In banking law, acted in commercial debt recovery actions instituted by leading local conventional and Islamic banks, in addition to acting for Danaharta, Malaysia’s national asset management company, in suits worth in excess of RM2 billion arising from defaults during the 1998 Asian financial crisis.Other highlights of my litigation career include representing families of passengers suing in Kuala Lumpur in one of the world’s largest Malaysia Airlines Flight MH370 lawsuits, and carrying out the first open water vessel arrest in Malaysia, of an LR-1 Aframax class oil tanker moored in littoral waters.
