Case Division - Construction And Design Defect Litigation
The CASE division of HHCP provides design and construction forensic services utilizing a wide range of disciplines from architectural, engineering and legal supporting attorneys, owners, design professionals and contractors prior to and throughout the litigation process. Specific services and issue areas include standard of professional care opinions, design errors and omissions, water penetration, construction sequencing, delay/constructive acceleration and contract document quality. Reviewed, evaluated and analyzed all forms of design and construction documents; electronic document review utilizing Concordance and Summation on a $25 million design error and delay claim by the owner against the design professional team, the case ultimately settled for policy limits. Drafted and prepared several standards of care opinion reports. Project files included an owner claim against the design professional for substantial delays causing significant cost over-runs on a $120 million hospital that ultimately settled for policy limits; and two water intrusion repair/remediation claims - one a thirteen building apartment complex and the other a thirty-six building planned residential town home community. Also assisted in the defense of the state's largest property casualty insurance carrier for alleged water intrusion damages related to the 2004 Florida hurricanes. The largest of these, an 18-story high-rise condominium tower with an alleged $25 million claim by the HOA ultimately went to trial resulting in a net jury award of under $5,000,000. HHCP estimated hurricane related damages at around $4,000,000.
