CurrentAs of May 1, 2013, primary legal oversight for Bank of America's Consumer Vehicle Lending consumer automotive finance and Dealer Financial Services commercial automotive finance operations. These lines of businesses include an "indirect" platform that acquires Retail Installment Sales Contracts from automobile dealerships, a "direct-to-consumer" platform that sources consumer-purpose automobile loans through the Bank of America website, Contact Centers, and Financial Centers, and a commercial platform that provides inventory "floorplan" financing to automobile dealerships. Areas of legal expertise include: federal consumer lending laws applicable to automotive financing (e.g., Military Lending Act, ESIGN, USA PATRIOT Act, Fair Credit Reporting Act, etc.) and regulations (e.g., B, M, V, and Z); state laws (e.g., UDAAP, notice to co-signors, GAP waiver/insurance, etc.); and consumer collections laws (e.g., right-to-cure, replevins, bankruptcy, etc.).Areas of regulatory compliance expertise include pronouncements and regulations promulgated by the Office of the Comptroller of the Currency and the Consumer Financial Protection Bureau as well as support of regulatory examinations, inquiries, etc.Prior to May 1, 2013, primary legal oversight for GWIM Mortgage Solutions and U.S. Trust Custom residential mortgage platforms including Merrill Lynch Home Loans. Areas of legal expertise include: real estate mortgage financing; consumer advertising; mortgage servicing; securities-based lending; residential mortgage loan sales and securitizations; real estate sales and brokering; federal and state consumer lending laws (e.g., TILA, RESPA, ECOA, etc.); state licensing laws which govern mortgage lenders and brokers including the SAFE Act; federal, state, and local taxes; foreclosures, work-outs, and bankruptcies; mergers, acquisitions, divestitures, and outsourcings; mortgage-related litigation including third-party process; and corporate governance/secretarial support.
