The Health Care Practice Group also advised and represented all types of health care providers and suppliers in administrative and judicial litigation involving fraud and abuse under Medicare and Medicaid, anti-trust matters, licensing and disciplinary proceedings by federal and state authorities and general civil liability and litigation matters.

The Health Law Section under his direction represented physicians, physician groups, medical staffs, health care provider associations, home health agencies in matters involving joint ventures, acquisitions and corporate mergers, as well as with business, tax and estate planning matters. The Health Law Section also advised and represented health care provider clients in matters involving federal and state laws and reimbursement and regulatory compliance, risk management, peer review, standard of care and fraud and abuse. The Health Law Section also represented health care providers in all staffing privileges and by-law procedures, licensing and disciplinary proceedings and general civil liability and litigation matters. Furthermore, the Health Law Section under his direction provided advice and representation to individuals with respect to claims under the Social Security Act and the Medicare and Medicaid statues. This position also involved representation of the firm’s non-health care provider clients in civil litigations matters.

The responsibilities of this position included management of the Office of the General Counsel, Department of Health and Human Services, Dallas, Texas, which consisted of 35 full-time attorneys and 20 additional support personnel. The Office of the General Counsel provides representation and advice to the many components of the Department of Health and Human Services, including the Health Care Financing Administration, the Office of the Inspector General, the Public Health Service, the Social Security Administration and the Office of Human Development Services. As the Deputy Chief Counsel he was directly responsible for all administrative and judicial litigation involving the agency in the five state region of Texas, Louisiana, Arkansas, New Mexico and Oklahoma.This responsibility involved practice in federal district and appellate courts in the five states as well as before the Armed Services Board of Contract Appeals, the Merit Systems Protection Board, the Office of Hearings and Appeals, Social Security Administration, the Equal Employment Opportunity Commission and the Grant Appeals Board. These responsibilities required experience and familiarity with civil and administrative procedure and agency regulations and programs as well as health care law (Medicare, Medicaid and disability), contract law, personnel labor law and civil rights law. The responsibilities of the Deputy Chief Counsel also involved first chair trial practice in administrative and judicial proceedings, the drafting of legal memoranda and documents and regular contact with high level officials of the Department of Justice, the Department of Health and Human Services, representatives of the five states in the region and a variety of opposing counsel.

Duties also included representation of the Health Care Financing Administration, Public Health service, Office of Human Development Services and the Office of the Principal Regional Official, requiring: rendering of legal advice and opinions involving interpretation of statutes, regulations and contracts; review of state and local legislation, regulations and guidelines; negotiating with federal, state and local government officials, private officials and their legal representatives.
