The European Union, commissioned, DAI Europe, UK to undertake study of Public Procurement Processes in six countries, including India. Everis, Barcelona, a subsidiary of DAI Europe, assigned me as the Legal and Public Procurement Consultant to do this study for India. The Task is to identify the legal, Statutory and Administrative framework under which Public Procurement is regulated in India. All the procurement agencies carrying out Public Procurement in India are to be identified, listed, and categorised in to structure of ‘Government Procurement Agreement’ (GPA). Public Procurement by Public Sector Undertakings (PSU) is to be specially studied and top procuring PSUs are to be analysed. Finally various preferential procurement policies have to be identified and list of barriers database is to be prepared.The report has been submitted to European Commission in July 2019.

The state of Rajasthan enacted the “Rajasthan Transparency in Public Procurement Act (RTPP Act)” in 2012, which was followed by the notification of “The Rajasthan Transparency in Public Procurement Rules”, (RTPP Rules) in 2013. Section 48 of RTPP Act envisages the requirement of professional standards, training, and certification for the officials dealing with procurement in the state.Accordingly, under the World Bank supported 'Strengthening Public Financial Management (SPFM) Project under Sub-component 2.1: Capacity Building on Rajasthan Transparency in Public Procurement Act and Rules, assessment of the training needs of procurement workforce in the State is to be carried out and appropriate strategy is to be developed for capacity building of all the procurement officials in the State to address such identified needs. The report has been accepted by the Government of Rajasthan.
International Public Procurement Consultant (W8)
The African Development Bank's (AfDB) current portfolio in South Africa's (SA) power sector is USD 3.2 billion (65% of the bank's entire portfolio in SA) and will further invest huge resources in the sector. Eskom Holdings SOC Ltd is fully South African Government owned integrated power utility that generates (42GW - 95% of SA), transmits and distributes electricity. Eskom plans to construct 6,561km of power delivery lines and had requested AfDB to finance a project which involves construction of 555km of 400kV new/ upgraded transmission lines.As part of due diligence, AfDB hired me as International Public Procurement Consultant to review procurement and associated contracting processes related to the transactions contemplated for funding by the Bank. The aim was to analyse the extent to which these processes were consistent with Core Values; AfDB’s procurement policy and Eskom’s own Procurement and SCM Policy and Procedures; Time-effectiveness; Cost Effectiveness; Quality effectiveness. Governance issues and adequacy of Eskom's procurement management capacities were also to be judged. Finally the report was to describe the Risks; suggest way forward and suggest improvements in Eskom’s procurement policies and procedures. The project has been completed on time.
