At the time of the bankruptcy filing ETS was operating a Ponzi scheme in which the founder had defrauded over 13,000 people of more than $400 million and the company was losing $1.5-$2.0 million per month on $5.0 million per month of revenue. ETS had operations in 43 states, Puerto Rico, Mexico and the U.S. Virgin Islands and its businesses included ATMs, air and vacuum machines and prepaid phone cards as well as payphones. • Restructured operations, including rationalization of staff and branch offices, increased reporting and operating efficiency and negotiated improved contracts with suppliers and customers.• Successfully reorganized company and turned around operations so that upon exit from bankruptcy the company was cash flow positive. Managed emergence from bankruptcy as a public company. • Negotiated agreement for sale of company’s assets and closed the sale transaction. Managed wind-down and liquidation of the company.• As de facto general counsel, oversaw all of company’s legal efforts through bankruptcy and thereafter, including settlement with Securities and Exchange Commission, settlement of class action with victims of Ponzi scheme and proceedings in United States Bankruptcy Court for the District of Delaware. Managed ETS’s assistance to U.S. Attorney’s Office in obtaining fraud conviction of company’s founder.
