Judgment in PDF.- Accident Exchange v Lea (2016): Acting for the Defendant on a credit hire claim. Proceeded to trial with case being dismissed against the Defendant. Judgment in PDF.- Accident Exchange v Yusuf (2016): Acting for the Defendant on a credit hire case where the Claimant discontinued following the filing of my Clients Defence. Pursued costs to provisional assessment. Beat the Claimants offer and recovered more than the amount on the bill of costs.- Murtaza v AXA Insurance UK PLC (2018): I recently acted for the Claimant on a Credit Hire case where the Defendant’s Solicitor served a statement from an in-house “Intelligence Analyst", circa 150 pages (6 weeks before Trial) inferring that the Claimant was dishonest. The statement exhibited social media searches, claims records etc. An immediate application was made to call the analyst to Trial. The Court heard the application shortly before Trial. The District Judge commented within the Order that the Intel Analysts' statement was “irrelevant, improper, embarrassing to the proper disposal of the claim and verifying (verging) on the abuse of the Court’s processes”. The Defendant was ordered to redact most of the statement which was irrelevant within 24 hours. Costs of the Application were also obtained. Shortly after serving the redacted statement the Defendant settled the Claimant’s claim with costs.
