Exercise full responsibility for providing technical guidance, and for the development and implementation of strategies, policies and procedures necessary for the effective management of an employee and labor relations program.Provide advice and assistance to employees and managers, and provide case management in matters relating to performance and conduct based actions, administrative grievances, reasonable accommodation requirements, performance appraisals, attendance, dispute resolution, and related employee relations issues.Responsible for the management of assigned Merit Systems Protection Board cases, and function as the primary representative before third parties.Work directly with management officials and staff in the negotiation of labor agreements, providing advice and guidance on labor relations issues.Work to resolve labor relations disputes using alternative dispute resolution techniques, and represent management at hearings before third parties.

This position was a five-year term appointment, which expired in late 2013. OIG team member, hired to investigate fraud, waste, and abuse, in the long troubled, multi-billion dollar, FCC Universal Service Fund, including examination of applications and documentation, interviews with experts, and USF recipients, and the execution of subpoenas and search warrants. Developed expertise in the Foreign Corrupt Practices Act, Telecommunications Act, False Claims Act, Improper Payments Information Act, and Inspector General Act. Worked in coordination with state, local and other Federal agencies including the Department of Justice, on civil and criminal investigatory and prosecutorial efforts. Trained in investigative techniques at the Federal Law Enforcement Training Center. Counseled FCC officials on a broad range of investigative activities.

Successfully represented the TSA, as lead attorney, in hearings and appeals before the Merit Systems Protection Board (MSPB), the Equal Employment Opportunity Commission (EEOC), and the Office of Special Counsel (OSC), on complex employment law matters, including those involving alleged violations of Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Equal Pay Act, the No FEAR Act, USERRA, Executive Orders, and other applicable laws, rules and regulations impacting Federal employment.Received winning decision in every case taken to full hearing and/or appeal.Devised and implemented litigation strategy, and managed all phases of case, including drafting of briefs and motions, overseeing discovery, conducting and defending depositions, preparing witnesses, and serving as first-chair attorney at hearings and appeals.Counseled TSA managers, including senior management from the Federal Air Marshal Service, on a broad range of employment and labor law issues.

Successfully represented the FDIC, as lead attorney, in hearings and appeals before the MSPB, EEOC, the Federal Labor Relations Authority, the Federal Service Impasses Panel, and the Office of the Special Counsel on complex labor and employment law matters, including those involving alleged violations of Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family Medical and Leave Act, the Equal Pay Act, the No FEAR Act, USERRA, Executive Orders, and other applicable laws, rules and regulations impacting Federal employment and labor issues.Counseled FDIC officials on a broad range of significant and first impression employee relations and labor management issues, including disciplinary and adverse personnel actions, leave and performance management, and employee counseling.Recommended and implemented policies, procedures and specialized employee programs, for which no specific guidelines had been developed.Prepared legal briefs, settlement agreements, advisory memoranda and other documents, including Final Agency Decisions, on highly complex and sensitive employment law issues.

Lead Counsel on multiple precedent setting actions involving novel and/or complex Banking Law issues, and/or large dollar amounts, in prototype FDIC office tasked with state and Federal court litigation, pertaining to failed financial institutions, with an emphasis on bankruptcy matters, and bank holding company litigation. Established case strategy and conducted all phases of commercial and other civil litigation, including preparation of pertinent legal documents, and appearing as attorney of record in court proceedings. Developed specialization in failed financial institution receiverships, bankruptcy, real estate, employment, tax, and environmental law, as well as FOIA, mortgage foreclosure practice, Alternative Dispute Resolution, and collections and judgment enforcement. Negotiated and prepared documents for commercial transactions, settlement agreements, and real estate transactions. Recruited to FDIC headquarters, to work in conjunction with the Department of Justice, in defending over 120 cases in the ground-breaking "Winstar Litigation," filed pursuant to the Financial Institutions Reform, Recovery and Enforcement Act of 1989. Lead Counsel charged with formulating responses to Congressional inquiries and FOIA requests, involving politically charged matters, directly related to the Clinton Presidency.
