Heather’s years as a litigation and advocacy attorney with the U.S. Army add to the number of experienced attorneys within Tully Rinckey PLLC’s military law practice group, where she is an associate. At the firm, she represents officers and enlisted service members in complex legal matters, including courts-martial, adverse command actions against troops such as administrative separations, Article 15 matters, and other forms of non-judicial punishment. Additionally, Heather protects service members from discrimination by asserting their rights under the Uniformed Services Employment and Reemployment Rights Act (USERRA). She also advises veterans on achieving optimal outcomes on claims and appeals for benefits that they have earned from the U.S. Department of Veterans Affairs. She assists veterans in upgrading their discharges to honorable and helps ROTC cadets avoid losing their scholarships. She assists clients with security clearance issues.

Supervises, investigates, and determines the course of action for tort claims to include medical malpractice, wrongful death, personal injury, and property damage alleged against the United States Army and/or its agents pursuant to the Federal Tort Claims Act (FTCA). Responsible for claims totaling over $500 million, and jurisdictions covering 16 states. Negotiates settlements involving trusts, annuities, and large cash payments with attorneys and claimants. Researches and prepares legal memoranda and presentations for the Department of Justice, Secretary of the Army’s designee, or the Deputy Judge Advocate General regarding claims subject to their approval. Develops and provides training to claims personnel on the US Army Claims Service procedures and the applicable law. As Military Magistrate, reviews requests for search/seizure authorizations and pretrial confinement decisions, and determines legal sufficiency.

Camp Casey, Republic Of Korea

Led, supervised, evaluated, and developed a diverse staff of professionals at busiest Trial Defense Service Offices in the Pacific Rim. Managed the operational functions of the office to include travel and training budgets. Provided criminal and administrative legal services to a community of over 50,000 servicemembers. Represented and advised Soldiers at all phases of trial and administrative hearings, with more than 30 trials and administrative hearings. Researched, drafted, and/or reviewed all documents prepared by the office to include motions, pleadings, offers to plead, and grants of immunity. Responsible for investigating complex criminal and administrative cases with limited resources and personnel. Created and delivered training to ensure the effectiveness and competence of defense counsel and paralegals. Conducted substantive reviews of training materials and presentations.

Provided criminal and administrative legal services to a community of over 50,000 servicemembers at one of the busiest and largest Trial Defense Service office in the United States Army. Represented and advised Soldiers at all phases of trial and administrative hearings, with more than 40 trials and administrative hearings. Fort Benning, Ga

Investigated, prepared and prosecuted all phases of trial and represented the United States at trial, administrative separation boards, pretrial confinement reviews, and pretrial investigations, with more than 80 trials and administrative hearings. Researched and prepared court papers and materials. Developed and delivered weekly presentations to peers and supervisors on military justice matters and created training in the areas of criminal justice and legal services for various audiences. Provided assistance and legal advice to Soldiers, dependents, and Retirees on issues of administrative law, civilian criminal matters, consumer protection and debt collection, family law, employment law, immigration law, taxes, torts, and estate planning. Provided interpretive guidance and opinions on legal matters to include, employment law, anti-discrimination law, Department of the Army rules and regulations, and Department of Defense directives.
