Significant matters include:• Complex commercial litigation involving forty-five cases consolidated under 28 USC § 1407 (MDL) and related state court action involving allegations of violations of twenty eight jurisdictions’ consumer protection laws, including California’s UCL and CLRA. Serve in second chair capacity with respect to all aspects of litigation. In state court proceeding, assist in researching and drafting of successful motion for judgment on the pleadings on the basis of California’s equitable abstention doctrine. This verdict was named one of the Top 10 defense victories of 2009 by the Daily Journal.• Representation of former CFO of corporation alleged to have backdated stock option in pending investigation by the SEC, DOJ and derivative litigations pending in Delaware state court and California state and federal court, as well as civil proceedings brought by the SEC.
