Ms. Herd is a partner in Rutan’s Trial Department and a member of the firm’s Business Litigation Section, representing companies and individuals in a wide variety of disputes, including matters involving creditors’ rights, breach of fiduciary duty and breach of trust, misappropriation of trade secrets, business ownership, separation and termination, landlord/tenant relationships and breach of contract. She has significant experience representing lenders – both banks as well as individuals and other entities – in disputes with debtors, particularly in the context of personal guarantees of real estate secured loans involving the California anti-deficiency and “one form of action” rules and in the receivership process. Ms. Herd was a member of the Board of Directors of OneOC, formerly the Volunteer Center Orange County, for 10 years and was Chair of OneOC’s Business and Finance Committee, regularly advising OneOC on various legal matters. Ms. Herd graduated magna cum laude, Phi Beta Kappa, from the University of California at Irvine in 1996 with bachelor’s degrees in Drama and Criminology, Law and Society. Ms. Herd received her J.D. from the UCLA School of Law in 2001. While at UCLA, she was Student Scholarship Editor of the Women’s Law Journal.Ms. Herd is a member of the State Bar of California and the Orange County Bar Association’s Banking and Lending and Litigation Sections. She is admitted to practice law in the United States District Court for the Central District of California.
