I have over 25 years of experience handling civil & criminal matters in the state & federal courts. I've defended people in Georgia, Tennessee, Florida, North Carolina and the District of Columbia. I have been lead counsel in more than 100 jury trials. I have completed virtually every national program offering specialized instruction on jury selection, trial skills and strategies in a DUI case. I also graduated from the National College for DUI Defense at Harvard University. I believe that an exhaustive investigation by a quality investigator or an analysis of the evidence by a leading expert in that particular field is often the difference between a guilty or not guilty verdict or a favorable plea agreement or an unfavorable one. We have a retired DUI Task Force officer with over 23 years of experience review your video. Many of the officers making DUI arrests have little or no experience making this type of arrest. Many officers improperly administer the field sobriety evaluations and also score them incorrectly. The officer often claims that the defendant failed the one leg stand test because they swayed and did not keep their arms down by their side. You are allowed to raise your arms up to 6 inches and almost everyone sways some while standing on one leg for 30 seconds. It has to be a noticeable or pronounced sway. My expert is an incredible witness. If he testifies in a refusal case that the officer failed to conduct the field sobriety tests properly, the tests have no value and the prosecutor is left without enough evidence to get a conviction. Of course he does review videos where he believes it is a good arrest.
