I started my career in 1986 with Skadden Arps Slate Meagher & Flom in New York doing, among other things, hostile takeover litigation and then transferred to Skadden, Arps’ San Francisco and then Boston offices. At each stop, I learned from among the clients’ business objectives are achieved by ethical but highly-aggressive representation with a premium on tactical foresight. In 1994, with Skadden Arps' support, I opened a boutique litigation firm in Boston with the goal, to borrow a phrase from Skadden Arps founder Les Arps, to provide the “upper-margin” of legal services. Over the years, we have been fortunate to represent a wide spectrum of clients, many of which were referred to us from large firms, in a broad variety of business disputes. Our cost structure made us appealing to start-up and technology companies seeking alternatives to large-firm cost structures. As a result, we have extensive experience in litigating in technology license disputes, including copyright and trademark issues. This led to work in California and New York where we opened small offices. Another consequence of our cost structure and my Skadden Arps experience is that we got involved in litigating corporate control disputes in non-public business enterprises, like LLPs and LLCs. As a separate practice, we advise and assist institutional investors in seeking to improve recoveries in the hundreds of securities litigation actions arising from their global equity portfolios, which payouts I call DIVIDEX™. To expand this service, I formed DIVIDEX Management, LLC to serve as a registered investment advisor to seek to manage and recover securities litigation claims as assets for clients, which launched in late 2014. To provide insurance against "loser pays" risk for those clients that join securities litigation outside the United States, I formed DIVIDEX Risk Insurance Company, a first-of-its-kind Delaware statutory trust.
