About Irvin Schein

When I was very young, my favourite TV show was "Perry Mason". It was a weekly drama about a criminal defence lawyer who won every case. From the first time I watched the show, I was intent on becoming a trial lawyer. My passion for winning in a courtroom (and, my wife would say, my passion for drama) has led me through over 35 years as a trial and appeal counsel. I have acted as counsel in a vast number of areas including corporate and business disputes, wrongful dismissal, negligence and tort claims, real property litigation including commercial development and leasing disputes, and solicitors' negligence and professional malpractice claims. I am also chair of both Minden Gross' litigation department and Vehiculaw, Minden Gross' motor vehicle dealers practice group.To some extent, the nature of dispute resolution has changed. Many people need problem solvers more than just gladiators. So I earned my LL.M. in Alternative Dispute Resolution at Osgoode Hall Law School in 2014. Since then I have developed an active mediation practice based mainly on my experience with business disputes but extending to all disputes in which emotional or volatile parties need to have a dose of reality administered (in an empathetic way, of course) by someone who has been around the block a few times. I am also listed as an arbitrator by the Canadian Commercial Arbitration Centre based in Montreal, QC.Industries served include financial institutions, commercial landlords, commercial tenants, accounting firms, real estate developers, builders, real estate agents and property managers, franchisors, software developers, insurers, importers and distributors, retailers, automobile dealerships, meat processors, trucking companies, and other entrepreneurs. Notwithstanding the fact that the actual loan amounted to approximately $200,000.00, the financial institution was ultimately ordered to pay almost $7 million in damages. This case is widely regarded as one of the most important lender liability cases in recent history.I have also achieved success on behalf of financial institutions, including a judgment of the Court of Appeal allowing his lender client to recover its funds where its mortgage was discharged in error notwithstanding that the provisions of the Registry Act appeared to dictate the opposite result. My experience in environmental litigation includes having acted for a financial institution whose mortgage security was impaired by toxic chemicals emanating from a neighbouring property. I have substantial experience with litigation of an international nature and routinely handle matters for companies based in the Unites States and the United Kingdom.I serve as a co-chair of the litigation section of Meritas worldwide and have been very active throughout his career as an author and lecturer on litigation practice related matters.
