James helps prevent, resolve and mitigate business disputes through planning, negotiation, arbitration and litigation. He acknowledges the Henry Ford quote, “Most people spend more time and energy trying to go around problems than trying to solve them,” and applies it to his practice: During and after a dispute, he examines the underlying issues – whether contracts or controls – and works to prevent them from reoccurring.James practices in three primary areas:Construction and Real Estate. Recognized as a Missouri/Kansas “Super Lawyer” for construction and surety law, he advises builders, suppliers, contractors, owners and sureties on contract negotiations, import/export issues, procurement, payment disputes and more. He has handled conflicts across the United States and on six continents. In one recent example, he secured a eight-figure payment for a client who struggled to collect on an EPC contract in Latin America.Non-Profit Organizations. James represents religious organizations and private and charter schools. He recently helped a primary school avoid state closure and renew its state charter. James’ experience as trustee of local, state and national religious and educational institutions guides his understanding of how to prioritize the health and growth of non-profits.Bankruptcy. James works to resolve issues stemming from bankruptcy. He represents secured creditors, preference defendants and others, often regarding construction or energy projects where clients delivered significant amounts of merchandise, materials, labor and construction services. Recently, he obtained summary judgment defending a preference claim, and obtained relief for a creditor in a South Korean tribunal.Active in the community, James taught government contract law at the U.S. Army Command and General Staff College at Fort Leavenworth, and is a recipient of the Boy Scouts of America – Heart of America Council’s Silver Beaver Award, the highest award presented to volunteers.
