About Jason Balich

Unlike most attorneys who have only been attorneys, I am also an engineer, an inventor, and a business owner. I understand technology, business and the law. I am the co-inventor of four U.S. patents. I have a B.S.E degree from Princeton and I worked at 3M Company as a product development engineer. I can tell you about thermoplastic gels, polyvinylene polarizers, silica nanoparticles, or any one of dozens of other technologies that I have worked on. I can defend your freedom to use that technology against threats from competitors or patent trolls—in district court, at the patent office (PTO), before the patent trials and appeal board (PTAB), or before the International Trade Commission (ITC).I defended a large global corporation—Sony—against a competitor asserting its patents at the ITC in a bet-the-company litigation that resulted in a favorable licensing deal. Most of my clients, however, are smaller privately owned manufacturing companies like ballistic helmet maker Galvion or telematics provider Geotab or any one of the generic pharmaceutical companies that I have worked with during ANDA litigation such as Actavis, Alvogen, Hetero Drugs, and Mayne Pharma in both district court litigation and at the PTAB.I am private pilot and fly a Cirrus SR22. I am an alpine, Nordic, and telemark skier and frequent mountains near Conway, NH, and usually make a trip out west once a year.     As a litigator for Wolf Greenfield, I help come up with a winning litigation strategy and translate that to the courtroom. I’ve defended Sony as respondent at the ITC against a competitor in the magnetic tape industry that resulted in a licensing deal favorable to Sony. I’ve helped a small Boston-based electro-hydraulic actuator company protect its IP rights in district court against a competitor. I’ve defended Canadian military helmet manufacturer Galvion in district court patent litigation. I’ve represented Precision BioSciences before the PTAB in an interference proceeding—and secured a win against a competitor, finding that Precision BioSciences was the first to invent a certain CAR-T cell technology. I’ve defended Canadian telematics company Geotab against patent trolls’ frivolous allegations of patent infringement.I also represent patent owners before the PTAB in inter partes reviews (IPRs) in technologies such as anti-viral nucleoside reverse transcriptase inhibitors for the treatment of HIV on behalf of the University of Minnesota, anti-cancer CAR-T cell therapy on behalf of the University of Maryland, multi-mode personal computers on behalf of Boston-based Litl, and botulinum toxin treatment for Medytox. Each of those IPR petitions were denied institution by the Patent Office’s PTAB. I have experience working in U.S. district courts in the Districts of Delaware, New Jersey, the Northern District of Illinois. I recently argued before the Seventh Circuit Court of Appeals. And I represent clients before the International Trade Commission (ITC) and the U.S. Patent Trial Appeals Board (PTAB).

I helped a pharmaceutical company address an FDA deficiency regarding an ANDA for a generic transdermal patch by coordinating magnetic resonance imaging (MRI) testing. And I evaluated whether drugs undergoing clinical trial would qualify for “new chemical entity” (NCE) exclusivity upon approval by FDA.

    As a product development engineer for 3M I led a new technology introduction team, creating a scratch-proof film that Dell used for its laptop computers. I also was the co-inventor of four U.S. patents: 6,814,899; 6,949,297; 7,378,136; and 7,820,236. Two related to the scratch-proof film project. One was a super adhesive that applied like tape (a pressure sensitive adhesive) but then could be UV cured for a super-hard bond. The last invention related to an improved poly-vinylene / polyvinyl alcohol co-polymer polarizer—a polarizer that would never fade.
