I'm a healthcare lawyer with Arnall Golden Gregory, where I Co-Chair my firm's Post-Acute Care Team, as well as our Health Care Litigation Team. I help healthcare companies solve complex regulatory and litigation problems, whether through counseling or in the courts. I'm also the past Chair the Post-Acute and Long Term Services Practice Group of the American Health Lawyers Association. On the hospice front, I serve on the Boards of the National Association for Home Care & Hospice (NAHC) and the Georgia Hospice and Palliative Care Organization. I also Chair NAHC's Foundation for Hospice and Homecare. I represent hospices, nursing homes, hospitals, home health and home care providers, and other institutional providers in government investigations, reimbursement, regulatory compliance and administrative disputes. My practice covers several primary areas: * Defending providers in False Claims Act (whistleblower) cases and investigations nationally* Defending UPIC audits and investigations, including handling appeals* Pursuing administrative appeals on behalf of providers to recover and maximize reimbursement under the Medicare and Medicaid programs* Representing providers in certificate of need (CON) matters in GeorgiaSuccess include:* Obtaining a precedent setting restraining order against the government and a ZPIC in a reimbursement appeal that threatened the viability of a hospice provider* Implementing a novel strategy of filing a federal lawsuit to successfully compel arbitration of a nursing home case, resulting in a decision of first impression in Georgia; * Compelling arbitration of a nursing home case, then prevailing at arbitration and receiving an award of attorney’s fees and costs against the plaintiff;* Obtaining a decision of first impression in Georgia establishing a statute of limitations for a cause of action for the False Claims Act retaliation provisions;* Gaining CON approval for a new cancer center over objections and administrative appeals by two competitors.Practice areas: Healthcare, litigation, mediation, arbitration, False Claims Act, government investigations, UPIC, certificate of need (CON), and Medicare.
