Jay is a Partner and leads the planning law team at Howes Percival. Jay's experience spans all areas of planning law from strategic residential development to retail, commercial and renewable energy schemes on behalf of national housebuilders, national and regional developers, promoters, investors and local planning authorities.Having led on a number of high profile appeals over the years, Jay also has vast experience in successfully defending judicial review challenges to planning permissions on behalf of applicants and local planning authorities; success that has included landmark decisions in the High Court, Court of Appeal and the Supreme Court. Notable cases include: R (Champion) v North Norfolk District Council [2015] UKSC 52R; R (Lensbury Limited) v Richmond London Borough Council [2016] EWCA Civ 814; and CK Properties (Theydon Bois) Limited v Epping Forest District Council [2018] EWHC 1649. Jay is therefore well rehearsed in complex planning issues such as Environmental Impact Assessment and Appropriate Assessment. He is continuously relied upon by his clients to support during the application and decision making processes to ensure planning permissions for new development are secured robustly and are safe from successful legal challenge. Jay also has considerable experience in drafting complex section 106 and infrastructure agreements for large scale residential-led and commercial developments across the country, and provides regular advice on other matters such as compulsory purchase, town and village greens, listed buildings consent and permitted development rights.
