Jean focuses her practice on health care transactional, regulatory, and enforcement defense matters. She represents a variety of clients across the health care industry, including hospitals, physician organizations, health care systems, and long-term and urgent care providers.Jean’s health care industry transactions experience includes mergers and acquisitions, divestitures, joint ventures, and due diligence for health care providers and investors across the United States. Her recent transactional experience includes representing a Fortune 250 kidney care company, providers of radiology services, a private equity funded cardiology platform, and a national veterinary practice. She also has experience in health care enforcement defense, including supporting clients undergoing federal and state agency investigations, preparing self-disclosures to federal and state agencies, and conducting internal compliance investigations. She regularly advises on various health care regulatory topics, including telehealth, scope of practice, and the corporate practice of medicine. Additionally, she advises clients in the cosmetics, medical device, and pharmaceutical industries on FDA regulatory and compliance matters.Prior to joining Mintz, Jean was an associate at a Long Island, New York-based boutique law firm that serves the health care industry, where she counseled clients on a broad range of health care compliance and health care litigation matters. During law school, Jean focused her professional and academic experiences on health law. She held legal internships at a national pediatric urgent care practice, a major nonprofit health care system in New York, and the Health Care Bureau of the New York State Attorney General’s Office. Upon law school graduation, she received the Excellence in Health Law Award and concurrently earned a Master of Public Health through her law school’s joint-degree program.

As an Advanced Gitenstein Fellow, I collaborate with the Institute on a variety of health law projects. These projects include the Hofstra|Northwell Medical-Legal Partnership, the CHAT Project, and our Advanced Care Planning Legal Mapping Project.

Ms. Krebs’ practice focuses on litigation, health care, and employment law, including managed care reimbursement, contract disputes, internal investigations, and compliance with health care and employment laws and regulations.

Assist with the acquisitions of urgent care businesses by researching state laws, including fee splitting, restrictive covenants, and corporate practice of medicine laws, and determining how such practices would be owned in the future. Oversee HIPAA breach analysis and notification process resulting from billing errors. Draft documents to assist with the launch of telemedicine practice. Revise affiliation agreements with universities and business associate agreements to ensure vendor compliance with HIPAA. Collaborate to create and produce internal health care compliance training and policies.

Assist patients in the Medical-Legal Partnership with legal issues arising under immigration, disability, housing, education, and health law.

I conduct research for a Professor at Hofstra University School of Law on legal issues that impact the transgender and intersex population of the United States. My research has involved various topics, including disparities in health and health care of transgender populations, how the law handles name changes, empirical data and studies on the lives of transgender people in the United States, and how the law defines gender and sexuality.

Collaborated with Professor Ostrow on research surrounding the "Not In My Backyard" (NIMBY) phenomenon, land use, and other regulatory issues surrounding property rights.

I assist Dr. Sanmartín with empirical research involving the Medicaid Expansion and its impact on methods of payment for substance abuse treatment, as well as research examining technology addiction. We are also working on research concerning long term care insurance and prescription drug monitoring programs. Professor Sanmartín and I have published Maria X. Sanmartín, Ryan M. McKenna, Mir M. Ali, Jean D. Krebs, Racial Disparities in Payment Source of Opioid Use Disorder Treatment Among Non-Incarcerated Justice-Involved Adults in the United States, 23 Journal of Mental Health Policy and Economics 19 (2020).

Drafted judicial order awarding damages under FLSA and New York Labor Law. Wrote bench memoranda on complex jurisdictional issues in multimillion-dollar litigation and in a social security appeals decision. Observed court proceedings.

Assisting with evaluation and calculation of penalties for a health care provider’s violation of an Assurance of Discontinuance. Conducting research for litigation prosecuting illegal shipment of tobacco products and deceptive promotion of opioids. Drafting memoranda on applicability of equitable tolling and continuing performance doctrine for breach of contract litigation.

Conducted research on Medicaid and Medicare Law, Mental Hygiene Law, and the False Claims Act. Revised internal presentations on the False Claims Act and Medicaid/Medicare Fraud. Drafted orders for involuntary treatment, doctor’s and attorney’s affirmations, and medication applications.

Conducted research and drafted memos on a variety of health law topics, including telemedicine, quality assurance, Stark Law and Anti-Kickback statutes. Prepared extensive fact chronology for litigation involving disposal of human remains. Created and revised presentations on HIPAA and informed consent for internal training. Drafted position statements in response to Equal Employment Opportunity Commission and N.Y. State Division of Human Rights complaints.

At Byrne Poh LLP, my job was to draft, file, and process Information Disclosure Statements (IDS) to the United States Patent and Trademark Office. In addition to this, I referenced patents and academic papers that are included in these statements.

I coordinated the research that the other undergraduate researchers of the Global Health Impact Team perform. I assist students with HIV/AIDS, tuberculosis, and worm data collection, systematic reviews, and oversee the research of other members of the team. In addition to these duties, I coordinated the weekly Skype meetings of the research team.

Peer tutor for courses in sociology, political science, and philosophy through Binghamton University's tutoring service. The courses that I am currently tutoring are Sociology 100A, Sociology 100B, Philosophy 146: Law and Justice, Phil 148A: Medical Ethics, Philosophy 121: Methods of Reasoning, and Political Science 117: Introduction to World Politics.

I worked in the Residential Life office located within the College-in-the-Woods living community at Binghamton University. I was a Student Assistant to the secretary of College-in-the-Woods. I assisted her in relations with residents of CIW, as well as tasks in the office such as answering questions that residents may have, welcoming people who enter the office, and running tasks for the secretary throughout the CIW community

I interned in the Congestive Heart Failure Unit of New York Methodist Hospital. I was selected from over 600 applicants for 60 spots to participate in the Summer College Intensive Program at New York Methodist Hospital this summer. I will be working with patients readmitted to the hospital after experiencing congestive heart failure and working with them to help them understand their treatment and ways to prevent CHF from occurring again. I am also an intern in the Catheter Lab of New York Methodist Hospital, and I work closely with the nurses to ensure that patient's needs are met and I observe cardiac procedures such as angiograms and electrophysiology diagnostic tests.

Interned in Trial Bureau IV at the Kings County District Attorney's Office. Throughout this internship, I was able to gain considerable knowledge of the court system, such as case management, and the process of obtaining subpoenas and other court orders. I was also able to witness multiple trials concerning narcotics, murder, and family court cases. I was entrusted with many jobs, including the drafting of subpoenas, motions, and having direct and indirect contact with legal personnel.
