Represent, counsel and partner with McDonald’s real estate development teams through all aspects of real estate acquisition and new restaurant development, including identifying, evaluating and communicating risk to legal and business leadership to facilitate fully informed decision making.• Draft ground leases, store leases, and purchase and sale agreements, and negotiate same with prospective landlords and sellers through execution.• Draft, review and negotiate ancillary documents and agreements including LOIs, development agreements, easement agreements, license agreements, confidentiality agreements, SNDAs, letter agreements, amendments to leases and Declarations, REAs, ECRs, and OEAs. • Review and analyze due diligence including environmental site assessments, title and survey, and cure title defects in preparation for closing.• Manage and assist paralegals in the performance of their responsibilities and resolve issues which arise prior to and during closing.• Assist and support construction teams through all stages of development; communicate with architects, engineers, consultants and general contractors concerning development plans; manage construction and post-construction issues including issues related to construction defects and mechanic’s liens.• Manage and consult with outside counsel retained in connection with permitting, zoning, land use and entitlements, as well as other litigation matters including condemnation negotiations, quiet title actions, and breach of contract claims.• Conduct all aspects of due diligence review for existing asset redevelopment programs to identify barriers to redevelopment and appropriate solutions.• Serve as Environmental Center of Excellence: a resource for attorneys, paralegals and development team members in relation to environmental matters.
