I began my career as a Bell Labs Research Engineer and attended Fordham Law School at night. Today, I combine extensive legal experience and technical acumen to help clients establish, expand, and defend critical IP assets.My litigation experience includes leading complex patent, trademark, trade secret, and copyright litigation including trial, claim construction, and appearances before District Courts, Federal Circuit Court of Appeals, USPTO Patent Trial & Appeal Board, International Trade Commission, Customs and Border Patrol, and arbitration panels. Rubard: Represented the plaintiff patentee and copyright holder against a competitor accused of copying a calling-card software code.TC Heartland v. Kraft Foods: Represented TC Heartland in convincing the Supreme Court to overturn decades of circuit precedent interpreting the patent venue statute.Bosch v. Costco: Represented Costco: won summary judgment of non-infringement of 4 Bosch wiper patents; won 6 successful parallel USPTO invalidity IPRs.SEC v. Matthew T. Mellon II et al.: Represented a billionaire cryptocurrency investor in a fraud investigation of Medient Studios Inc., and in settling an administrative proceeding unrelated to the fraud.Represented the bondholders in the $4.5 Billion bankruptcy sale of Nortel patents.
