Actions to prosecute individuals whose actions interfere with client Web sites or Internet activity often include extensive Internet forensic work, cease-and-desist actions, and formal litigation.Privacy and Data Security: I conduct privacy assessments for large and small clients and advise them regarding privacy and data protection laws, anti-spamming and anti-phishing statutes, state data protection statutes, breach notification laws, consumer protection laws such as the Fair Credit Reporting Act, and fair debt collections practices statutes. I work with them to improve their internal governance policies and procedures to better manage the information they collect and handle.International Data Transfers: I help companies transfer data across borders in compliance with local and international laws and standards, including advice as to how to operate Sarbanes-Oxley Whistleblower programs in the EU, conduct U.S.-based litigation discovery in the EU, and comply with emerging international data protection standards. I counsel clients on compliance with European Union Directives on privacy, data protection, eCommerce, and electronic communications services.Virtual Currency and Blockchain: I help emerging virtual currency and blockchain technology companies evaluate their regulatory compliance obligations, in particular anti-money laundering, money transmission, and privacy-related laws.
