As a Building, Construction & Infrastructure Partner at Mills Oakley, I undertake a variety of front-end, dispute and security of payments work. My recent experience includes: Front-end Work- reviewing, advising and negotiating in relation to department of defence documentation on behalf of a national contractor for works on sensitive defence sites;- advising an ASX-listed Australian-based multi-national company on risk issues and contract formation with a Swiss-registered entity;- advising an Australian public company undertaking bulk earthworks projects to rehabilitate former sites in management of contractors, formation of contracts, site specific risks in relation to subsequent purchasers and complex drafting issues; and- reviewing and negotiating, for an Australian construction company, contracts for the performance of nationally significant export terminal projects.Dispute Work - assisting a large local government authority and the superintendent manage a recalcitrant contractor, including providing advice on repudiation, mechanisms for recourse under contract, effecting termination and seeking recourse;- involvement in litigation in multiple jurisdictions, including instructing in the Victorian Court of Appeal and the Supreme Courts of New South Wales and Victoria; and- advising a contractor in relation to risk issues arising from flood damage, including in respect of claims by subcontractors and claims for extension of time and delay costs under the head contract.Security of Payments - preparation of detailed payment claims and schedules – including template payment schedules for sophisticated contractors;- preparation of submissions to adjudicators on complex points of law, including in relation to the levying of liquidated damages arising from contract administration delays; and- preparation of and the supervision of the preparation of supporting evidentiary material.

As Senior Associate at Carter Newell, John developed experience in: - providing high level strategic and risk-related legal advice to numerous principals and contractors;- reviewing and advising on form, formation, drafting and negotiation of numerous types of contracts for construction, civil works, maintenance, services and consulting for principals, contractors and consultants; - drafting provisions to reflect negotiated risk allocation; and- large and medium scale litigation in multiple jurisdictions (including in the Victorian, New South Wales and Queensland Supreme Courts, and the Victorian and Queensland Courts of Appeal).

During his time at Carter Newell, John had the opportunity to go on secondment to the Brisbane Airport Corporation as their sole in house construction lawyer. His duties included: - negotiating and developing all manner of agreements with contractors and consultants (including sole negotiation of contracts with an aggregate value of approximately $200M);- risk evaluation, negotiation and amendment of outside contracts proposed for use;- providing internal advice to project managers and superintendents on all manner of complex construction dispute and project issues; and- providing advice on policy and risk issues to BAC management and board on a broad range of matters.
