Representative Matters• Defense of multinational pharmaceutical company in nationwide multidistrict antitrust class action brought by various purchasers alleging an industry-wide cartel involving price-fixing and customer allocation agreements and conspiracies, and in related direct action litigation.• Counseled and conducted investigations for multinational pharmaceutical company in response to grand jury and investigatory subpoenas from the Department of Justice and state attorneys general concerning price fixing and market allocation for generic drugs.• Advised global drug manufacturer in responding to civil investigative demand related to calculation and reporting of prices used for Medicaid and Medicare rebates. • Representation of drug distributor in nationwide litigation relating to the distribution of prescription opioid medications in connection with opioid abuse crisis. • Served as counsel to drug manufacturer on antitrust risks associated with potential inaccurate listing of patent information in FDA Orange Book.• Successfully represented founder of life sciences data company in dispute with former investor alleging fraud and breach of contract related to sale of stock, resulting in dismissal with prejudice for all claims against client, affirmed on appeal. • Recovered investment capital for medical technology investors resulting in recoupment of entire investment.• Defended NYSE-listed drug manufacturers regarding claims throughout the U.S. challenging drug pricing practices, violations of state and federal False Claims acts, Federal Anti-Kickback statute, state consumer protection acts, and other state statutes governing business practices. • Obtained multi-million dollar settlement for global public relations firm in dispute with former executives over violation of restrictive covenants.
