I advise and represent East Bay Municipal Utility District (EBMUD), a public water/wastewater agency, in matters arising under water and environmental law, and I supervise our office's attorneys and staff who work on environmental and natural resources matters. My focus is on water rights and natural resources. I represent EBMUD's interests in water rights negotiations and disputes, and disputes and proceedings before the court and the State Water Resources Control Board (SWRCB). I handle matters arising under EBMUD's Central Valley Project (CVP) contract with the U.S. Bureau of Reclamation and under the Sustainable Groundwater Management Act (SGMA). I also provide strategic advice and counsel for internal and multiparty water resources planning and development initiatives.I also oversee EBMUD's legal, regulatory, and enforcement matters arising from EBMUD's conveyance and treatment of wastewater and drinking water under environmental laws (CEQA; Clean Water Act; Porter-Cologne; Safe Drinking Water Act; Clean Air Act; hazardous waste disposal and remediation laws). I have negotiated discharge and air permit requirements, provided legal and regulatory compliance advice, performed investigations, responded to and defended against environmental enforcement proceedings involving regulators such as U.S. EPA, the Regional Water Quality Control Board (RWQCB), the California Department of Fish and Wildlife (CDFW), and the Bay Area Air Quality Management District (BAAQMD), and assisted EBMUD in exercising its own environmental enforcement authority. From time to time, I advise on other legal issues common to public agencies, such as contracts, public procurement, CEQA, rates/charges/fees/assessments, legislation, open meetings (Brown Act), and public records.
