Joshua B. Alper’s primary practice area is complex commercial litigation. He has significant litigation experience in both state and federal courts, representing clients in a wide range of matters. His experience spans the spectrum of disputes that arise in the commercial litigation context, including complex breach of contract cases, malicious prosecution, fraud, breach of fiduciary duty, shareholder actions (both direct and derivative), non-compete matters, broker commission cases, class actions, misappropriation of trade secrets, tortious interference, writs of garnishment and replevin, securities litigation, as well as disputes under the Uniform Commercial Code.Mr. Alper also has significant experience representing secured and unsecured creditors in bankruptcy court in adversary proceedings and contested matters under Chapters 7, 11, and 13 of the Bankruptcy Code. In this connection, he has handled the prosecution and defense of preference and fraudulent transfer actions, and has been involved in contested confirmation hearings.
