My practice includes a range of defense experience in pharmaceutical, cosmetic, women’s personal care, medical device, OTC, and complex industry-wide litigation, including representing clients against unconventional theories of liability and junk science. I am a member of the national counsel litigation team on infusion pain pump litigation and in the New England Compounding Pharmacy fungal contamination mass tort. I serve as national, regional and local counsel for Fortune 500 pharmaceutical and medical device companies, pharmacies and cosmetics manufacturers. I represent owners, contractors and material suppliers against claims of negligence, breach of contract and warranty and professional malpractice in multi-million dollar toxic mold and water intrusion construction defect matters alleging pecuniary losses including lost revenue and payments to tenants, and remediation, design and renovation costs in property damage and personal injury litigation.I also regularly provide counseling to companies concerning pre-litigation risk assessments and company submissions to FDA, including package inserts, patient package inserts, and other labeling, warnings and NDA filings; product brochures; direct-to-consumer advertising; website content; press materials and media kits; sales and training materials and programs; pharmacovigilance and the development and use of risk minimization action plans and RiskMAP. Additionally, to help clients avoid potentially damaging legal actions, I examine pre and post market liability issues relating to clinical trials, marketing and product recalls. Further, I represent health care entities in complex health care litigation including defense of hospitals, physicians, and clinics in medical malpractice claims.
