Justin D. Justin was the second chair in a three-week jury trial involving claims of sexual harassment and was responsible for examining multiple witnesses. In addition, Justin conducts compliance audits relating to FLSA and state wage and hour law, pay practices, employment and human resources procedures, and provides compliance counseling for clients. Justin has performed compliance audits for small technology start-ups, established Silicon Valley companies, and multi-state employers. Justin also provides acquisition deal support to provide clients with employment liability exposure, required deal provisions based on employment practices, and to assist with acquisition negotiations.Justin has been seconded to several clients, in which Justin gained valuable in-house perspective and worked with various business units to update nationwide policies, advise on restructuring and layoff disputes, manage litigation matters, and resolve issues with permanent and contingent workers.

As a Personnel Board Member, I served in an advisory capacity to the City Council and city manager in matters pertaining to City employee personnel administration. I heard appeals of any City employee who was reclassified, suspended, demoted, or terminated, and served as the final fact-finder for the appeal and made a decision in conjunction with the other members of the Personnel Board. In my role as Chairman I ruled on evidentiary objections, conducted the meetings, and lead deliberations.

In my role as an on-site secondee at Cisco, I provided advice on employment and personnel matters for employees nationwide.

While at Pahl & McCay I represented employers in all facets of employment litigation and advising on recent changes or trends in California employment law. Additionally, I worked with property managers and developers in real estate transactions, leases, construction build-outs, and any related litigation. I handled multiple DFEH and EEOC investigations and drafted responsive position statements dealing with retaliation, discrimination, and hostile work environment claims. I was also involved in a 300 person class action Department of Labor investigation dealing with wage and hour violations pertaining to immigrant work visas and took the depositions of multiple former employees.
