Her areas of expertise include:• statutory and common law employment agreements;• developing enforceable restraint of trade provisions and seeking injunctive relief for clients;• modern award and enterprise agreement interpretation;• conducting complex and sensitive workplace investigations; • providing advice relating to termination of employment and organisational restructures;• industrial relations litigation, strategy and advice; and• general employment law advice and litigation.Kaitlyn's significant matters include acting for the Director of the Fair Work Building Industry Inspectorate in a Federal Court civil penalty prosecution against the CFMEU and the CFMEU Victorian Branch President alleging numerous breaches of the Fair Work Act 2009 (Cth) and acting for two national clients in separate Supreme Court proceedings against two former employees to seek interlocutory injunctions, including successfully obtaining and executing an Anton Piller order.Kaitlyn acted for Peninsula Support Services in the landmark decision of a Full Bench of the Commission which established the temporal scope of the new anti-bullying jurisdiction such that workers who have been bullied prior to 1 January 2014 can seek orders aimed at preventing bullying from continuing or reoccurring (Kathleen McInnes). She also acted in the landmark Mammoet case before the High Court of Australia regarding the prohibition on making payments to employees during protected industrial action under the Fair Work Act 2009 (Cth) (Construction, Mining, Forestry & Energy Union v Mammoet Australia).In October 2016, Kaitlyn became a Law Institute of Victoria Accredited Specialist in Workplace Relations, having successfully completed a rigorous assessment process testing experience, technical knowledge, writing and practical advocacy skills.
