Advocacy through fearmongering and falsehoods displaced rational conversations based on factual analysis at an unprecedented speed. Personal relationships were being sacrificed on the altar of political correctness which, at the end of the day, was generally based on feelings and presumptions rooted in subjective truth claims grounded in, well, nothing. As an associate, Kelley worked on trademark prosecution and counseling matters involving a broad client base of international consumer products companies. She advised and counseled clients on the selection, adoption, maintenance, and enforcement of their trademarks and drafted opinions on the availability and proper use of trademarks. Kelley prepared, filed, and prosecuted U.S. trademark applications before the U.S. Patent and Trademark office and enforced and policed trademarks and service marks. She participated in opposition and cancellation proceedings before the Trademark Trial and Appeal Board. In addition, she assisted with counseling clients on a variety of copyright matters and conducted extensive research on complex issues of trademark and copyright law.

Kelley spent a significant amount of time working on Internet-related trademark disputes. She worked with firm attorneys on a wide variety of trademark prosecution and counseling matters. She assisted in drafting opinions and preparing, filing, and prosecuting U.S. trademark applications before the U.S. Patent and Trademark Office as well as participating in opposition and cancellation proceedings before the Trademark Trial and Appeal Board. Kelley also assisted in preparing, filing, and prosecuting U.S. copyright applications before the U.S. Copyright Office.

Kelley managed the business side of a law firm as Director of Administration and saw first-hand how business works. This unique experience provided a solid foundation for her career as an intellectual property attorney. She managed operational processes, recruiting, training, and compensation and gained valuable insights that would later help her advise and counsel her business clients about trademark and copyright matters.

As a secondary instructor at a private college preparatory school, Kelley developed and taught courses in law, ethics, and English. She learned how to develop a curriculum and tailor coursework to students’ needs. Kelley uses these skills today as an intellectual property law speaker and educator.

Working in the Executive office of the National Intellectual Property Law Institute gave Kelley unique experience and expertise in trademarks and copyrights. She managed the Continuing Education Program for the Institute for all United States jurisdictions and supported on location research for all foreign travel (19 countries), including communication with United States and foreign embassies and high-level government, academic, industry, and judicial personnel in Washington, DC and abroad. She developed procedural and documentation manuals and researched a wide variety of intellectual property issues in support of the Institute’s educational programs. Kelley also provided paralegal support and conducted legal research for trademark and copyright prosecution and litigation matters for an affiliated law firm. She drafted initial pleadings and briefs for prosecution and litigation matters in the U.S. Patent and Trademark Office and federal district courts.
