I practice almost exclusively in the representation of owners, contractors, subcontractors, material suppliers and design professionals in construction industry matters and disputes. I assist clients in a broad array of construction contract and project related issues including: bid protests; bid responsiveness and responsibility; subcontracts and the subcontractor listing law; rules governing award of contracts; drafting and/or negotiating prime and subcontracts; design/build contracts; lump sum and guaranteed maximum price agreements; best and final offer procurements; prompt payment legislation; liquidated damages; minority and disadvantaged business enterprise participation; performance issues including compliance with specifications; time of performance provisions; critical path analysis (as related to responsibility for delay and delay damages); differing site conditions; rights to additional compensation as a result of changes, including impact damages; liability of principals and sureties on bid, performance and payment bonds; mechanic's liens and stop notices; right to recover on a total cost or modified total cost basis; right to recover reasonable value when a contract is abandoned or rescinded; rights to terminate construction contracts for cause or convenience; construction defects; and other construction related claims.
