“Construction Defect Unit”, a division of the Legal Department, a ‘start up’ division, in Atlanta, presented with the challenge of increasing the closing ratio on existing files transferred into the office. Initiating procedures of accelerating the legal Discovery and directing defense counsel’s activities, resulted in the closing ratios increased by 25% and simultaneously, experiencing a significant reduction in legal expenses. Indemnity payment were significantly reduced by developing strategies to get all parties involved in discussing their differing positions during the initial phases of the claims rather than the usual “CD” practice of waiting until immediately prior to trial. Contributing, also to the significant Indemnity savings was accurate coverage determinations made in these rather complex matters. “Major Case Unit” in Duluth managing the day to day handling of the more complex litigated files evaluated in excess of two hundred and fifty thousand dollars, in various jurisdictions, in various states. The aggressive handling of these claims archived consistent results and assisted CNA achieving its financial objectives.
