I advise on all healthcare case investigations at the NY office and assist with the evaluation, guidance, and technical assistance required with the application of ERISA, all Part 7 laws and regulations including HIPAA and ACA, MHPAEA, No Surprises Act (NSA) and the Consolidated Appropriations Act (CAA). In this role, I provide support in developing the legal argument, determining compliance, and will engage internal stakeholders and external parties in the course of the investigations. I enjoy a leadership, advisory and mentoring role in the office and often conduct training, engage in research and give presentations internally and to the public on the DOL investigations, applicable statutes and regulations, initiatives, and regulatory issues regarding health and welfare benefit plans. Conducts thorough investigations and reviews of private entities for compliance with the multifaceted issues of the Employee Retirement Security Act of 1974 (ERISA) with retirement and welfare plans, and service providers. These investigations involve simple defined contribution plans, defined benefit plans, or large service providers, custodians, and large financial institutions, and require in-depth interviews, and extensive document review. I am knowledgeable about Title I of ERISA, DOL regulations and guidance, Affordable Care Act (ACA), HIPAA, MHPAEA; all of which are analyzed in determining whether there are ERISA fiduciary violations, and I ultimately work with sponsors to achieve compliance with ERISA. I have worked large investigations that involve small teams, inter-agency coordination, litigation preparation, and have worked to restore millions back into retirement plans, welfare plans, and ultimately participants. I enjoy a leadership role in the office, and enjoy assisting the office achieve its goals, and developing our staff through training and mentoring.
