With my experience gained over 30-plus years of practice, I have worked with and against all sides - debtors, creditors, big banks, private equity/hedge funds, small businesses, large corporate conglomerates, borrowers, individuals, owners and management, committees and trustees. Restructurings always involve operational and financial concerns, and some combination of internal and external drivers. Prior to starting our boutique firm, I worked at a multi-state firm and handled all sizes of cases for local and national banks and non-traditional lenders, so I understand and appreciate their concerns first-hand. I have worked with and against every size of "big-law" and I also know how they operate. Filing bankruptcy is never an ideal, and is not the outcome most would choose, but it is a tool to bring all constituencies together and see what some creative bargaining might produce. Often just working through how a reorganization might work leads to some agreements without the court oversight. Results matter, leadership matters, and making hard choices matters. Doing nothing is a choice and usually does not work out. My job is to help clients become educated and make informed choices.
