Mensing, 564 U.S. ––––, 131 S.Ct. 2567 (2011). Represented PLIVA, Inc., before the U.S. Supreme Court after successfully petitioning for writ of certiorari to review the decision of the Eighth Circuit Court of Appeals. The Supreme Court granted PLIVA's petition for writ of certiorari despite the absence of a conflict among the federal appellate courts and reversed the decisions of the Eight and Fifth Circuit Courts of Appeals. The decision has been dubbed a "landmark decision" in the area of pharmaceutical litigation. The Supreme Court held state-law tort claims against generic drug manufacturers are preempted under the Supremacy Clause of the U.S. Constitution by the Federal Food, Drug, and Cosmetic Act, and the Food and Drug Administration's regulations.
