I am one of the founding partners of Kelly IP, a trademark boutique law firm representing some of the world's most well-known brands. I represent clients in all aspects of trademark law, from counseling on selection of marks all the way through federal court appeals. I represent clients in a variety of industries, but have particular expertise in the interplay between trademark law and the First Amendment, and represent major entertainment, news, and media companies. I regularly advise on clearance, prosecution, and enforcement matters involving trademarks used as titles of or elements in motion pictures, television programs, books, and video games, as well as collateral merchandise associated with these properties. My expertise in this area also extends to right of publicity and copyright matters. I am the author of three of the leading articles on trademarks and the First Amendment, “Twenty Years of Rogers v. Grimaldi: Balancing the Lanham Act with the First Amendment Rights of Creators of Artistic Works" and "Another Decade of Rogers v. Grimaldi: Continuing to Balance the Lanham Act with the First Amendment Rights of Creators of Artistic Works," both published in the Trademark Reporter; and "Recent Shifts in Rogers v. Grimaldi: Looking for a Genuine Artistic Motive," published in the ABA Entertainment Reporter.I am also very experienced in the area of pharmaceutical trademarks, and the unique challenges and obstacles faced in this industry. I am the author of "Naming a Drug in Just One Color: Trademark Protection for the Organoleptic Properties of Pharmaceuticals," which was published in Trademark World.Finally, I'm the current President of the Association of Intellectual Property Firms, an organization dedicated to supporting IP boutique firms in running and managing their practices.
