Marc Lombardi is Chair of Shipman’s Privacy, Cybersecurity and Data Innovation practice group. With more than 20 years of privacy law experience, Marc provides clients strategic business consulting on all aspects of information policy including privacy, cybersecurity, data incident response and data asset management. Represented hospitals in physician practice acquisitions and advised executives on compliance with the Stark Law, Anti-Kickback Statute, and protection of tax-exempt status. Negotiated and drafted asset purchase agreements, physician employment agreements, and other related documents, and performed due diligence analysis. Negotiated and drafted various joint venture and partnership agreements, employment agreements, independent contractor agreements, and commercial contracts including an EMR implementation and Master Purchase Agreement.Advised various clients regarding compliance with HIPAA and the HITECH Act, drafted HIPAA privacyand security policies, and performed HIPAA compliance reviews.Advised various Connecticut hospitals regarding the Certificate of Need (“CON”) implications of theirbusiness plans. Drafted CON determinations, applications, petitions for status, witness testimony andcross-examination questions. Played a key role in the research, drafting, and strategy of a declaratory ruling proceeding raising issues under the Connecticut General Statutes and the United States Constitution.
