Thanks to many years of work with clients with foreign capital (mainly construction companies, but not only) I have gained extensive experience in court proceedings and settlement negotiations. The court cases conducted by me usually involve disputes regarding:• payment of remuneration for construction works (including those against the jointly and severally liable orderer), • payment of remuneration for completed (and not accepted by the orderer) additional or replacement works, • payment of contractual penalties, • payment of compensation (in connection, among other things, with the need to entrust work to be carried out or repaired to another entity under replacement performance), • refund of amounts retained as a guarantee of good performance of the contract or as warranty deposits,• obligation to perform repairs under the quality guarantee, etc. I have successfully conducted for my clients lawsuits between subcontractor and general contractor, between subcontractors as well as between general contractor, subcontractor and investor (i.a. GDDKiA, on the basis of FIDIC contracts and public procurement law ). I also represent clients in enforcement cases (in which, for example, the bailiff carried out the seizures of unjustified claims of a given entity - subcontractor or further subcontractor towards my client), cases recognized in security proceedings (e.g. for forbidding payment of the security guarantee demanded by the investor) or in bankruptcy proceedings (reg. e.g.: notifying claims and possibly representing the client in the proceedings initiated by the opposition against placing or not placing of a given claim on the receivables’ list drawn up by the trustee). My Law Office also provides other services for entrepreneurs, including all services related to ongoing corporate issues for commercial law companies.
