CurrentBusiness lawyer with expertise in bankruptcy litigation, loan workouts, creditors' rights and fraud recoveries. Served as federal equity receiver in multiple federal court lawsuits brought by federal regulatory agencies.SummaryI have been a commercial litigation attorney - with an emphasis on financial institutions litigation - for more than 25 years. My clients describe me as a creative problem solver, which I think is a fair assessment. As a commercial/bankruptcy lawyer with substantial jury and non-jury trial experience, I am fully competent to handle clients' litigation needs, but I also always keep in mind that any litigation, no matter how straightforward it might appear, carries risks. With that in mind, I always try to determine whether there are means of avoiding expensive litigation. My goal is to solve problems, and to use litigation as a last resort to do that if negotiation and reason won't work.I also have served as a federal equity receiver in multiple lawsuits brought by the Federal Trade Commission, the Consumer Financial Protection Bureau and state Attorneys General. Most of the cases involve allegations that the defendant companies engaged in fraudulent activities, and my job, typically, is to investigate the companies, shut them down if I conclude that they are in fact engaging in unlawful actions, and then collect the assets of the companies pending a final ruling from the court. This typically involves forensic accounting, which I handle personally, and sometimes litigation against non-parties who have possession of receivership assets, or who are legally responsible to me as receiver.
