About Mark Loveday

Mark advises and appears in courts and tribunals in a wide range of property disputes. Clients include the major London estates, private property groups, local authorities and retailers.He is General Editor of "Service Charges & Management" (Sweet & Maxwell), the leading legal text on property management, the fifth edition of which was published in January 2022. He is also editor of "Rent Review: A Surveyors Handbook" (RICS, 2008).Mark was lead counsel for the Respondents in FirstPort Property Services v Settlers Court RTM Co - the first right to manage case to reach the Supreme Court. In 2023, he appeared in the Court of Appeal in Dell v Holland Park Management, in what is believed to be the single largest individual residential service charge dispute to come before the tribunals. He also also appeared in Avon v Canary Gateway (Block A) RTM Co, which established important rights for shared ownership leaseholders.Mark is currently advising clients about the Building Safety Act 2022 and the Leasehold and Freehold Reform Bill.Specialisms: Property litigation - including service charges, management, leasehold enfranchisement, right to manage, rent review and business tenancy renewals.Mark's column on residential property matters appears every week in the Times Bricks & Mortar section.
