As a partner in the Newcastle office of Moray and Agnew Lawyers, I practise in insurance law defending and resolving damages claims. Having worked in-house with GIO for five years early in my career and later having been a director of an industry superannuation fund trustee, I am very conscious of the legal, regulatory and reputational environment in which insurance claims staff operate each day. I have over 32 years’ experience as an insurance litigator and adviser and have been an Accredited Specialist in Personal Injury Law since 1996. In that time, I have successfully managed and resolved many claims including slips and falls, professional indemnity, motor and industrial accidents. I have conducted claims for indemnity and recoveries, nervous shock and compensation to relatives claims. I am often asked by insurer clients for ad hoc telephone advice and assistance about matters they are dealing with in house, a service I very happily provide.My experience also extends from dealing with unlitigated claims, direct claimants and foreign residents to matters involving infants, the aged and infirm, to advising on indemnity, policy and statutory interpretation questions, to utilising various modes of dispute resolution including mediation, to litigation in various courts involving all sorts of factual and legal complexities, multi-party matters, fraud, limitations issues and administrative law and appeals. On occasion, I also appear as advocate for my insurer clients.In recent years, I have also been asked to advise and to prepare responses and submissions for a major insurance client to an industry regulator and also to the Privacy Commissioner arising from complaints about claims handling and privacy issues, valuable experience which has emphasised for me the level of scrutiny to which insurers can be subject.
