Mark Biernacki has over a decade of experience with litigation in all areas of intellectual property, and he regularly advises and assists clients in acquiring and enforcing intellectual property rights, including by: providing registrability and freedom-to-use opinions; preparing, filing and prosecuting trade-mark applications; registering copyrights; representing clients in opposition procedings; developing and implementing enforcement strategies; commencing civil proceedings; and negotiating settlements. He has successfully represented both plaintiffs and defendants before the Federal Court of Canada, the Federal Court of Appeal, and the Ontario Superior Court of Justice.Mr. Biernacki has worked with clients ranging from small businesses to multinational corporations as well as universities and governmental agencies. He has experience interacting with clients directly, through in-house counsel and through external counsel.
