I have worked in 119 countries, in commercial, non-profit, and academic sectors.     Conflict Management Group helped to add value in major disputes of international public concern. We intervened at senior levels working with Presidents, Prime Ministers, and Foreign Ministers to provide advice and mediation or conciliation services.Our work in South Africa had a profound impact on millions of people. We trained F.W. de Klerk’s cabinet ministers and Nelson Mandela’s leadership at the ANC. I also worked with the current President of South Africa, who was at the time the lead negotiator, to kick off constitutional negotiations.Another client we worked with was Oscar Arias who went on to receive a Nobel Peace Prize for his efforts in 1987. As President of Costa Rica, he hired the Conflict Management Group to create peace agreements throughout central America. We worked with the Presidents of Nicaragua, El Salvador, Guatemala, and Honduras to help with the wars in Central America in the early 1980s. Conflict Management Group merged into Mercy Corps in 2004.

    Conflict Management, Inc. was formed by me, Roger Fisher, and Bruce Patton, co-authors of our bestselling book on negotiation, “Getting to Yes: Negotiating Agreement Without Giving In,” and two other colleagues, Liz Gray and Terry Barnett.Prior to the publication of Getting to Yes, negotiation was thought to be something you couldn’t learn from a book. Conventional wisdom was that negotiation skills were based on judgment, timing, and experience, which could not be learned from a book or taught in a class. Speaking with expert negotiators around the world such as diplomats, labor leaders, lawyers, government officials, and executives, we distilled their wisdom on negotiation into a simple common-sense framework that became the backbone for “Getting to Yes.” Taking the ideas in our book, at CMI we created useful tools for individuals and groups to more effectively manage their differences and create value. We created the Seven Element approach to negotiation that is the backbone of what many leading consulting and training firms now use as their core negotiation methodology.     Upon completing my education at Harvard Law School, I began my career as an Associate Attorney practicing corporate law at Cravath, Swaine & Moore. Working at one of the world’s leading law firms, I helped to pioneer interest rate swaps before they came into existence. I worked primarily representing commercial and investment banks, and my two main clients were Salomon Brothers and Chemical Bank.Working over 3,000 billable hours per year was (surprisingly) exciting and energizing. In the early 1980’s we had more work than we could handle, and clients really appreciated all we did to represent and support them. Taking you back to prehistoric times, it is hard to imagine the nascent state of technology and work automation. It was before the days of PCs, and documents were drafted in pencil on a legal pad. I had an IBM mainframe terminal that I used to organize deal documentation for 400 swap deals at a time. It was an interesting challenge and one that makes me thankful that our technology has advanced as it has (and a time that is unimaginable to my son Josh, an IP lawyer who could not conceive of legal practice in the days before computers and mobile telephony). My experience as a practicing corporate attorney has served me well in any analytical context as well as negotiations involving complex deal terms, legal concepts, and other legal documentation.
