About Mary Kelly Persyn

As a lawyer, advocate, speaker, and author, I’m deeply passionate about racial and social justice, education equity, children’s rights, and LGBTQ rights. Through my legal and advocacy work, I’ve acquired a deep understanding of the challenges facing vulnerable children and youth as well as the legal issues that often contribute to or result from those circumstances.My rich and varied professional career has included a mix of academia, legal work, nonprofit management, board service, and community leadership. As a lawyer, I’ve handled government enforcement litigation and appellate practice at Am Law 100 firms as well as a combination of in-house counsel and amicus/advocacy work for civil rights, social justice, and children’s rights. I bring extensive knowledge about adverse childhood experiences and toxic stress, as well as critical race theory and social justice knowledge (and orientation), to my matters. I currently serve as the Vice President of Legal Affairs for Boys & Girls Clubs of San Francisco. We work every day to support and care for the kids and families who need us most. Our mission is to inspire and enable all young people, especially those from disadvantaged circumstances, to realize their full potential as productive, responsible, and caring citizens. I'm deeply proud to play a role in supporting this work as in-house counsel.I am an elected member of the American Law Institute and participate(d) in the Members Consultative Groups for the Restatement of Children and the Law and Restatement of Constitutional Torts. As of August 2024, I am a Commissioner of the Sexual Orientation and Gender Identity Commission of the American Bar Association. I served as member and ultimately Chair of the Center for Youth Wellness, a nonprofit founded by California's Surgeon General, Nadine Burke Harris. CYW, now a program of Safe & Sound, is committed to improving the health and well-being of children and young people affected by adverse childhood experiences. I serve on the Advisory Council of the United Way of the Bay Area and as amicus committee chair of the American Professional Society on the Abuse of Children. When I’m not working, you can find me hiking, biking, traveling, or cooking with my husband and twin teens. An SF native, I’m also a former elite cyclist and runner who loves the challenge of endurance sports and the great outdoors.I appreciate connecting with others who are also passionate about civil rights, social justice, and children’s advocacy. Since 1891, Boys & Girls Clubs of San Francisco (BGCSF) has provided high-quality, community-based youth development services to youth in San Francisco.     Persyn Law & Policy proudly serves nonprofit legal and community organizations, focusing on child and youth advocacy with special expertise in the impacts of child trauma, early adversity, and toxic stress. In 2019, PLP served as lead counsel to the American Professional Society on the Abuse of Children and 36 pediatric health care professionals and child advocates as amicus curiae in the Supreme Court DACA case, DHS v. Regents of UC (decided June 2020). PLP currently represents APSAC as amicus curiae in Doe v. Abbott, the Texas case on gender-affirming care for minors.PLP's significant matters included providing policy, legal, and strategy advice to the NAACP Legal Defense and Education Fund, Inc., and the Blue Ribbon Panel on Transparency, Accountability, and Fairness in Policing (San Francisco); representing the American Professional Society on the Abuse of Children as amicus curiae; and providing training on child trauma and early adversity to clients including the Kansas Judicial Circuit, the Sonoma County Bar Association, and school districts in California. I served as a pro bono attorney for Clemency Project 2014 and a Prepared to Vote attorney (Election 2016) for the NAACP LDF. I currently serves as a pro bono panel attorney for Legal Services for Children. In 2018, the American Professional Society on the Abuse of Children honored me with a Special Recognition Award. Persyn Law & Policy has acted as counsel of record for amicus briefs in the U.S. Supreme Court, the U.S. Courts of Appeals for the Second, Fourth, and Ninth Circuits, and California Court of Appeal. I am happy to review requests for amicus assistance in cases related to child toxic stress, child maltreatment, and educational equity and opportunity via my role as Chair of the Amicus Committee of the American Professional Society on the Abuse of Children.

    The Amicus Committee analyzes legal and public policy issues to which APSAC may lend insight and expertise, including those that advance our goal of fighting systemic racism and bias in the child welfare system. I have been chair since January 2021. The committee files amicus briefs in state and federal court and develops briefs and position papers for the Board to review and approve. In recent years, the committee has facilitated APSAC participation in amicus briefs on immigration issues including the Muslim "Travel Ban," DACA, and the conditions of federal detention of migrant and refugee children at our southern border. Currently, we are leading an amicus coalition in the Doe v. Abbott litigation in support of plaintiffs' defense of gender-affirming care for minors in Texas.
