I am program counsel to the Department of Energy’s Office of Environmental Management, Office of Environment, Health, Safety and Security, and Office of Enforcement. I manage and oversee the work of thirteen attorneys and frequently advise the Secretary of Energy and brief Members of Congress and staff on environmental issues associated with various Department of Energy sites and facilities.Selected Legal Experience:• I managed and negotiated the January 2016 agreement with the State of New Mexico settling the legal issues associated with the packaging of transuranic nitrate salt waste drums at the Los Alamos National Laboratory.• I managed and negotiated the January 2016 agreement with the State of New Mexico settling the legal issues related to the 2014 release of radioactive materials from the Waste Isolation Pilot Plant.• I was a key advisor in the negotiations and eventual litigation with the State of Washington concerning the 2010 Consent Order governing the construction and initial operation of the Waste Treatment and Immobilization Plant. • I oversaw and negotiated the 2016 Consent Order with the State of New Mexico governing the cleanup of legacy waste at the Los Alamos National Laboratory.

Responsibilities included leading and coordinating the response to all documentproduction requests from Congress.Selected Legal Experience:• I led and coordinated the production of documents related to the Solyndra project.• I managed and negotiated the settlement of claims with the U. S. Environmental Protection Agency related to an airborne release of radioactive material at the Separations Process Research Unit in New York.

Responsibilities include counseling agency clients on issues associatedwith environmental and land use concerns.Selected Legal Experience:• I successfully led the coordination with the Department of the Interior, the Bureau ofLand Management, and the General Services Administration that resulted in the termination of a Public Land Order covering 739 acres at the Nevada National Security Site and resulted in those acres being transferred to Department of Energy ownership. My efforts avoided costly litigation with the State of Nevada over the use of those acres for the disposal of low-level radioactive waste.

I was the Department of Energy’s first Attaché in Baghdad and regularly led and coordinated my activities with representatives from other Coalition embassies, the Departments of State and Defense, and the National Security Council. Selected Experience:• I advised the Ambassador and Deputy Chief of Mission and various high-ranking Iraqi Government officials relating to the Iraqi Government’s effort to pass and implement the Hydrocarbon Framework Law, the Revenue Management Laws and other laws associated with the development of Iraq’s petroleum resources and infrastructure.• I was appointed as United States representative to the Iraqi group commissioned by the Iraqi Prime Minister to oversee the disposition of nuclear materials and the cleanup of Iraq’s damaged nuclear site at Tuwaitha, Iraq.

I directed and supervised five senior attorneys and one paralegal in the disposition of legal matters related to the effort to obtain a Nuclear Regulatory Commission license to construct and operate a geologic repository for spent nuclear fuel and high-level radioactive waste at Yucca Mountain.

My responsibilities included representing positions taken by the General Counsel on legal issues to the Under Secretary, Assistant Secretaries, other Federal agencies, stakeholders, and members and staff of congressional committees. Selected Legal Experience: • I managed legal issues associated with the security of the domestic nuclear fuel cycle, nuclear non-proliferation, international commerce in high-enriched and low-enriched uranium, and the operation of the Department’s uranium enrichment facilities.

My responsibilities included litigating claims in the Court of Federal Claims and District Courts. Selected Legal Experience: • I litigated and prevailed in a case involving the Mining Law of 1872. • I was also represented the Department of the Interior in the case of Cobell v. Babbitt, involving Indian trust funds.

I counseled agency clients on environmental issues involved in the handling of nuclear materials, including compliance with the National Environmental Policy Act and the Resource Conservation and Recovery Act.

I counseled agency clients on issues involving the Federal Land Policy and Management Act, water rights acquisition, mineral leasing, oil and gas production, and the Mining Law of 1872.
