As a senior member of the firm’s employment practice group Mr. Cebrian represents management clients in connection with all types of matters arising under federal and state law, including claims based on Title VII, FEHA, FMLA, ADA, and ADEA. Specifically, Mr. Cebrian specializes in claims involving wrongful termination, harassment, wage and hour, discrimination and whistle blowing/retaliation claims. In addition to his active litigation practice Mr. Cebrian also advises his clients with regard to employment related risk management and crisis management. Selected Client RepresentationGarcia v. Mercado Latino (2011) – Achieved a dismissal in a wrongful death action brought against a security guard company following a fatal shooting at a concert in May of 2007. Plaintiffs contended the security company’s failure to provide adequate security at the concert resulted in Plaintiffs’ death and demanded $14,000,000.00. The case was dismissed on summary judgment and Plaintiffs’ took nothing by way of their complaint. Smallwood vs. Fremont Surgery Center (2010) – Wrongful termination/Discrimination/Fraud complaint dismissed after motion for summary judgment, dismissal affirmed on appeal.Stracener/Gray v. Wild Idol Saloon (2010) -- Catastrophic Injury /Premises Liability case involving multiple plaintiffs who suffered significant and disabling injuries following a riot at a bar, settled favorably following Plaintiffs’ depositions. Paulk v. Walnut Avenue Women’s Center (2008) – Whistleblower/wrongful termination and wage and hour case involving a battered women’s shelter successfully resolved on the eve of trial.King & Kelleher v. Carpenter (2006) – Breach of contract/cross-complaint for malpractice, following a lengthy jury trial received a defense verdict on legal malpractice and fraud claims and was awarded significant fees on cross-complaint. Verdict upheld on appeal.
