The team is nationwide, and has defended technology providers, consumer-facing companies, and employers in over 150 class actions and arbitrations involving claims under the Biometric Information Privacy Act (BIPA), Genetic Information Privacy Act (GIPA), Video Privacy Protection Act (VPPA), California Invasion of Privacy Act (CIPA), state rights to publicity acts (including IRPA), other state privacy laws, and claims involving website technology, including pixel, website analytics and session replay technology that is currently the focus of a litigation surge in California state and federal courts. We are also defending multiple clients in the current surge of Illinois GIPA litigation. We defend companies in multiple states, including California, Illinois, and Florida, based on the use of common website tracking/analytics and the growing use of AI in both the consumer and retail context. I have argued and won some of the most significant BIPA appeals, garnering defense victories before the Seventh Circuit Court of Appeals in Miller v Southwest Airlines (labor law preemption) and Fox v Dakkota (standing).
