CurrentI am a partner in MSB Solicitors heading the employment law team and working with my partner Neil Kelly, in the commercial law department. Working with small to medium sized enterprises in the northwest, MSB Solicitors offer legal advice on business and personal disputes. Employment law matters are increasingly complex and always of great importance to employers and employees. We will advise either party. Even when the best preparations are made, disagreements arise in the workplace and commercial mediation is increasingly replacing the more difficult, expensive option of civil litigation/ tribunals. My work in this field involves many different client industries such as pharmaceutical, construction, property and manufacturing. One of the hazards of being in business is the threat of professional negligence claims. Although this is often associated with medical professionals, I also help clients who are architects, surveyors and other solicitors. The professional person is deemed to be more highly skilled than the average person and has a duty of care to the people who use their services. If a client is injured as a result of negligent care, they can sue for damages.Negligence may also be a factor in construction litigation where homeowners or commercial property owners have discovered defects during or after the construction process. Construction litigation is an area of law that largely concerns disputes that arise under construction agreements and often involve numerous parties including the general contractor and a subcontractor, and can become quite complex where the quality and scope of work performed is involved.
